Service Agreement for FastOn Logistics

Effective Date: February 7, 2026

⚠️ Important Notice

Please read these Terms and Conditions carefully before using FastOn Logistics services. By accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.

1. Acceptance of Terms #

By accessing or using FastOn Logistics services (including our website, mobile applications, and logistics services), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

Agreement Formation

A binding agreement is formed when you:

  • Create an account on our platform
  • Request a shipping quote or book a shipment
  • Use any of our logistics services
  • Submit a package for delivery
  • Make payment for our services

🔞 Age Requirement:

You must be at least 18 years of age to use our services. By agreeing to these terms, you represent that you are of legal age to enter into a binding contract.

2. Service Description and Limitations #

2.1 Our Services

FastOn Logistics provides courier and logistics services including, but not limited to:

Same-day and next-day shipping within Mumbai and beyond

✓ Freight Shipping

Domestic and international cargo transportation

✓ Warehousing

Secure storage and inventory management

✓ E-commerce Logistics

Fulfillment and last-mile delivery solutions

2.2 Service Limitations

We reserve the right to refuse service for:

  • Prohibited or restricted items (see Section 3.2)
  • Packages exceeding weight or dimension limits
  • Destinations outside our service areas
  • Shipments with incomplete or inaccurate information
  • Customers with outstanding payment obligations

2.3 Service Availability

While we strive for uninterrupted service, we do not guarantee:

  • 24/7 availability of online booking systems
  • Delivery on specific dates or within guaranteed timeframes during unforeseen circumstances
  • Access during scheduled maintenance or system upgrades

3. User Responsibilities and Prohibited Uses #

3.1 Your Obligations

When using our services, you agree to:

  • Provide Accurate Information: All shipment details, addresses, contact information, and package contents must be truthful and complete
  • Proper Packaging: Secure packaging appropriate for the contents and shipping method
  • Correct Labeling: Ensure packages are clearly labeled with sender and recipient details
  • Declared Value: Accurately declare the value of shipment contents for insurance purposes
  • Compliance: Follow all applicable laws, regulations, and customs requirements
  • Account Security: Maintain confidentiality of your account credentials
  • Timely Payment: Pay all charges according to the agreed payment terms

3.2 Prohibited Items

⛔ The following items are strictly prohibited:

  • Illegal drugs and narcotics
  • Explosives and ammunition
  • Hazardous chemicals and materials
  • Flammable liquids and gases
  • Weapons and firearms
  • Counterfeit goods and currency
  • Perishable food items (without approval)
  • Live animals (except with special arrangements)
  • Human remains or body parts
  • Stolen property
  • Items infringing intellectual property
  • Other items prohibited by law

Shipping prohibited items may result in immediate termination of service, legal action, and liability for all related costs and damages.

3.3 Prohibited Uses

You may not use our services to:

  • Engage in fraudulent or illegal activities
  • Harass or harm our staff, partners, or other customers
  • Circumvent payment or tracking systems
  • Reverse engineer or attempt unauthorized access to our systems
  • Transmit viruses, malware, or harmful code
  • Misrepresent package contents or value

4. Payment Terms #

4.1 Quotes and Pricing

  • Quote Validity: All quotes are valid for 7 days from issuance unless otherwise stated
  • Price Changes: Prices may change based on package weight, dimensions, destination, or service type
  • Additional Charges: Extra fees may apply for remote locations, customs clearance, fuel surcharges, or special handling
  • Currency: All prices are quoted in Indian Rupees (INR) unless specified otherwise
  • Taxes: Prices exclude GST and other applicable taxes unless explicitly stated

4.2 Payment Methods

We accept the following payment methods:

Credit/Debit Cards

Visa, Mastercard, RuPay

UPI

GPay, PhonePe, Paytm

Net Banking

All major banks

Corporate accounts may be eligible for credit terms upon approval.

4.3 Payment Terms

  • Prepayment: Payment is required before shipment dispatch unless credit terms are approved
  • Corporate Accounts: Net 30 payment terms available for approved business customers
  • COD (Cash on Delivery): Available for select services with additional fees
  • Invoice Due Date: Invoices must be paid within the specified payment period

4.4 Late Payments and Fees

Late Payment Policy:

  • Overdue invoices will incur a late fee of 2% per month (24% per annum)
  • Shipments may be held or service suspended for accounts with outstanding balances
  • Legal action may be pursued for unpaid invoices exceeding 90 days
  • Collection costs and legal fees will be added to outstanding amounts

4.5 Refunds and Cancellations

Refund eligibility depends on service type and timing:

  • Before Pickup: Full refund minus processing fee (3%)
  • After Pickup: Partial refund based on completion stage
  • In Transit: No refund available (package return can be arranged)
  • Delivered: No refund unless service guarantee was not met
  • Processing Time: Approved refunds processed within 7-10 business days

5. Shipping Terms and Liability #

5.1 Delivery Timeframes

Estimated delivery times are provided as guidance only and are not guaranteed. Actual delivery may vary due to:

  • Weather conditions and natural disasters
  • Traffic delays and road closures
  • Customs clearance processes (international shipments)
  • Recipient unavailability or incorrect address
  • Government restrictions or security measures
  • Technical failures or operational disruptions

5.2 Liability Limitations

Our liability for loss, damage, or delay is limited to:

Consequential Damages Not covered

We are not liable for indirect, incidental, special, or consequential damages including lost profits, business interruption, or reputational harm.

5.3 Insurance Options

Full value protection

Coverage up to declared value (max ₹5,00,000)

Additional 2% of declared value

5.4 Claims Process

Filing a Claim:

  1. Notification: Report loss or damage within 48 hours of delivery (or expected delivery date)
  2. Documentation: Provide tracking number, photos of damage, packaging materials, and proof of value
  3. Inspection: We may inspect the package and packaging before processing the claim
  4. Review: Claims are reviewed within 10-15 business days
  5. Resolution: Approved claims paid within 30 days of approval

Important: Claims filed after 48 hours may not be accepted. Accepting delivery without noting damage on delivery receipt may affect claim eligibility.

5.5 Undeliverable Packages

If a package cannot be delivered due to:

  • Incorrect or incomplete address
  • Recipient refusal or unavailability
  • Customs issues or prohibited contents

We will:

  • Attempt to contact sender and recipient
  • Hold package for 7 days at nearest facility
  • Return to sender (return shipping charges apply) or dispose after holding period
  • No refund for shipping charges on undeliverable packages

6. Intellectual Property Rights #

Our Intellectual Property

All content on our website and platforms, including but not limited to:

  • FastOn Logistics name, logo, and trademarks
  • Website design, layout, and graphics
  • Software, code, and tracking systems
  • Text content, images, and videos
  • Proprietary algorithms and processes

Are protected by copyright, trademark, and other intellectual property laws. All rights are reserved by FastOn Logistics.

Prohibited Uses

Without our express written permission, you may not:

  • Copy, reproduce, or distribute our content
  • Modify, adapt, or create derivative works
  • Use our trademarks or branding for commercial purposes
  • Reverse engineer our software or systems
  • Remove copyright or proprietary notices
  • Frame or mirror our website content

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for their intended purpose. This license does not include any rights to our intellectual property.

7. Disclaimer of Warranties #

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We Specifically Disclaim:

  • Merchantability: No guarantee that services meet your specific requirements
  • Fitness for Purpose: No warranty for particular use cases
  • Non-Infringement: We don't warrant that our services don't infringe third-party rights
  • Accuracy: No guarantee of error-free operations or accurate information
  • Availability: No promise of uninterrupted or timely service
  • Security: No absolute guarantee against data breaches or cyber attacks

Some jurisdictions do not allow exclusion of implied warranties. In such cases, these disclaimers may not fully apply to you.

Third-Party Services

We use third-party carriers, payment processors, and technology providers. We are not responsible for their actions, errors, or service failures beyond our control.

8. Limitation of Liability #

⚠️ Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTON LOGISTICS' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED:

The Lesser Of:

₹50,000 OR The amount you paid for the specific service

Excluded Damages:

We are NOT liable for:

  • Indirect Damages: Lost profits, business interruption, lost data
  • Consequential Damages: Secondary losses resulting from our service
  • Incidental Damages: Costs incurred due to service issues
  • Special Damages: Unique circumstances or losses
  • Punitive Damages: Penalty damages beyond actual loss

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.

Exceptions to Liability Limitations

These limitations do not apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Any liability that cannot be excluded or limited by law

9. Indemnification #

Your Indemnification Obligation:

You agree to indemnify, defend, and hold harmless FastOn Logistics, its officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:

  • Your Use of Services: Any claims resulting from your use or misuse of our logistics services
  • Breach of Terms: Violation of these Terms and Conditions
  • Prohibited Items: Shipping illegal, prohibited, or hazardous materials
  • False Information: Providing inaccurate or misleading shipment details
  • Third-Party Rights: Infringement of intellectual property or other rights
  • Legal Violations: Non-compliance with applicable laws and regulations
  • Damage to Third Parties: Harm caused by your shipments or actions

Defense and Settlement

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You will cooperate fully in the defense and may not settle any claim without our prior written consent.

10. Termination of Services #

10.1 Termination by You

You may terminate your account at any time by:

  • Contacting our customer service
  • Submitting a written request to support@fastonlogistics.com
  • Using the account closure feature in your profile settings

Note: Outstanding invoices must be settled before account closure. No refunds for prepaid services.

10.2 Termination by Us

We reserve the right to suspend or terminate your access immediately, without notice, for:

  • Breach of Terms: Violation of any provision in this agreement
  • Prohibited Activities: Shipping restricted or illegal items
  • Non-Payment: Failure to pay outstanding invoices within 30 days
  • Fraudulent Activity: Suspected or confirmed fraud
  • Abusive Behavior: Harassment of staff or other customers
  • Legal Requirements: Compliance with law enforcement or court orders
  • Risk to Operations: Actions that threaten our business or reputation

10.3 Effect of Termination

Upon termination:

  • Your right to use our services immediately ceases
  • We may delete your account data after 30 days
  • Outstanding payment obligations survive termination
  • Sections relating to liability, indemnification, and dispute resolution continue to apply
  • In-transit shipments will be completed or returned at your expense

11. Governing Law and Dispute Resolution #

11.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of:

  • Republic of India
  • State of Maharashtra

Without regard to conflict of law provisions.

11.2 Jurisdiction

You agree that any legal disputes arising from these terms or our services shall be exclusively subject to the jurisdiction of the courts in Mumbai, Maharashtra, India.

11.3 Dispute Resolution Process

Before initiating legal proceedings, we encourage the following resolution steps:

Informal Resolution

Contact our customer service to discuss the issue. Most disputes can be resolved amicably.

Formal Complaint

Submit a written complaint to our legal department with detailed information and supporting documentation.

Mediation

If unresolved, both parties agree to attempt mediation through a mutually agreed neutral third party.

Arbitration

Disputes may be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.

11.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in any class action, collective action, or representative proceeding against FastOn Logistics.

12. Force Majeure #

Excuse from Performance:

FastOn Logistics shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to:

Natural Disasters

  • Earthquakes, floods, tsunamis
  • Hurricanes, cyclones, storms
  • Fires, lightning strikes
  • Epidemics, pandemics

Government Actions

  • Wars, military actions, terrorism
  • Government orders, lockdowns
  • Import/export restrictions
  • Strikes, labor disputes

Infrastructure Failures

  • Power outages, blackouts
  • Internet or telecom failures
  • Transportation disruptions
  • Port or airport closures

Other Circumstances

  • Cyber attacks, data breaches
  • Acts of God
  • Third-party service failures
  • Unforeseen events

Notification and Resumption:

We will make reasonable efforts to notify affected customers of force majeure events and resume services as soon as practicable. No refunds or compensation will be provided for delays caused by force majeure.

13. Changes to These Terms #

Our Right to Modify

We reserve the right to update, modify, or replace these Terms and Conditions at any time at our sole discretion.

Notification Methods:

  • Email Notice: Notification sent to your registered email address
  • Website Banner: Prominent notice on our homepage
  • Updated Date: "Effective Date" at the top of this page will be revised
  • Advance Notice: Material changes announced at least 30 days in advance

✓ Acceptance of Changes:

Your continued use of our services after changes become effective constitutes acceptance of the updated terms. If you do not agree with the modifications, you must discontinue using our services.

We encourage you to review these Terms and Conditions periodically for any updates.
